TERMS OF SERVICE

These Terms of Service govern the use of the SaaS e-commerce platform provided by Commernix Software and Technology Services Ltd. ("Commernix", "we", "company"). By using the platform, you agree to these terms.

1. SERVICE DESCRIPTION

Commernix is a software-as-a-service (SaaS) platform that enables users to create and manage cloud-based e-commerce stores. The service includes store infrastructure, payment integrations, hosting, and technical support.

2. ACCOUNT CREATION AND SECURITY

To register on the platform, you must be over 18 years old and have the legal capacity to enter into contracts. You are responsible for the security of your account and must not share your password. You are responsible for all activities that occur under your account.

3. ACCEPTABLE USE

You may only use the platform for lawful purposes. The following activities are strictly prohibited:

- Selling illegal products or services - Copyright infringement or violation of intellectual property rights - Spam, malware, or phishing activities - Actions that overload or disrupt platform infrastructure - Unauthorized access attempts to other users' data - Publishing misleading, fake, or deceptive content

Violations may result in immediate account suspension or termination without prior notice.

4. PAYMENT AND SUBSCRIPTION

Subscription fees are collected in advance on a monthly or annual basis. Prices are stated in Turkish Lira (TRY) including VAT. Price changes are communicated at least 30 days in advance.

5. SERVICE CONTINUITY AND SLA

Commernix targets 99% uptime. Scheduled maintenance is announced in advance. Liability for damages arising from service interruptions is limited to the subscription fee paid for the relevant month.

6. INTELLECTUAL PROPERTY

Platform software, design, and content belong to Commernix. Users retain ownership of the content they create in their own stores. Content uploaded to the platform grants Commernix only a limited license for service delivery purposes.

7. DISPUTE RESOLUTION AND JURISDICTION

Disputes arising from this agreement shall first be resolved through negotiation. If unresolved, Istanbul (Çağlayan) Courts and Enforcement Offices shall have jurisdiction. Turkish law applies.

8. CHANGES TO TERMS

Commernix may update these terms with prior notice. Continuing to use the platform after updates take effect constitutes acceptance of the new terms.
